Trasological Expertise during the Investigation of Property Destruction or Damage
Abstract
The article determines the specifics of conducting the search of the scene of an incident in the investigation of the destruction or damage to property, the tasks of the trasological examination for this category of crimes are outlined as well. Scientific methods of analysis, such as induction and deduction were used when writing the article. The following forensic aspects of crime traces examination were considered: forensic, follow-up and trasological, as well as properties of material traces of crime, in particular, information, individuality and sustainability. It is noted that the study of trasological research is always conducted with respect to the traces of the material world. At the same time, the values of the material world are also the subject of criminal encroachment in crimes of the destruction and damage to property.
The classification of information sources is analyzed, which is perfectly suited for their systematization in the investigation of crimes related to the destruction or damage to property, and is divided into three groups: personal, material and mixed (complex or systemic). Features of the inspection of the scene of crime in this category of crimes are given. The tasks of the trasological expertise are determined and its types are outlined. Since, in accordance with Art. 84 of the Code of Criminal Procedure of Ukraine, the source of evidence in criminal proceedings is the expert’s conclusion, then in the investigation and disclosure of crimes related to the destruction or damage to property, trasological examination occupies one of the main places. Such criminal activity is oriented towards material values, which are affected by the instrument of the material world, and the study of trasology is precisely the material trace-mappings. The tasks and possibilities of this type of expertise given in the article create an idea of the effectiveness of the use of special knowledge in the field of trasology in order to establish facts that are important for the investigation and clarification of the truth in criminal proceedings.
