INCREASING THE LIABILITY FOR PETTY THEFT OR THE DECRIMINALISATION OF THEFT: CURRENT SITUATION AND POSSIBLE WAYS OF DEVELOPING THE ISSUE
Abstract
У статті охарактеризовано проблему щодо розгляду матеріалів кримінальних
правопорушень за ознаками ст. 185 КК України, вчинених в умовах воєнного стану, що
утворює особливо кваліфікований склад злочину, з покаранням у вигляді позбавлення волі
на досить тривалий термін. Наведено статистичні дані щодо зареєстрованих у 2023
році кримінальних проваджень за фактами вчинення злочинів, передбачених ст. 185 КК
України, та їх подальшої спрямованості. Наголошено на необхідності вдосконалення
правового регулювання цього питання, проаналізовано положення законопроєкту
щодо внесення змін до Кодексу України про адміністративні правопорушення про
посилення відповідальності за дрібне викрадення чужого майна та прийнятого Закону
України від 18 липня 2024 р. № 3886-ІХ «Про внесення змін до Кодексу України про
адміністративні правопорушення та деяких інших законів України щодо посилення
відповідальності за дрібне викрадення чужого майна та врегулювання деяких інших
питань діяльності правоохоронних органів» та сформовано зауваження і пропозиції
до розглянутих положень.
