Coordination Activities of the Investigator during the Investigation of Criminal Offenses Related to Domestic Violence
Abstract
Abstract. Rational coordination of actions between units of the National Police of Ukraine is not only an important form of functioning, but also necessary for achieving the general goal, i.e. ensuring law and order and countering criminal and illegal manifestations in society. In legal science, such activity is called interaction. The relevance of the article is due to the fact that in the investigated category of criminal wrongdoing, information about the course of violent relations in the family, behavior and personal characteristics of family members, etc., is possessed by a significant number of structural units of the National Police of Ukraine and other subjects of the executive power. Therefore, the task of the investigator is not only to obtain such information, but also to ensure proper coordination between them, with the aim of its thorough analysis and study, with the aim of forming investigative tactics and the evidence base. The purpose of the article is to determine the main roles and functions of individual units during the investigation of criminal offenses related to domestic violence, as well as tactical and organizational principles for unifying the investigator's capabilities of each of the participants in the interaction in identifying and researching evidentiary information. To achieve this goal, the method of legal hermeneutics was used to analyze legislative acts and court decisions on the investigation of criminal offenses related to domestic violence; the decomposition method was also used to detail the possible ways for the police to obtain information about a committed criminal offense. As a result of the study, the form (procedural and non-procedural) of such interaction was determined, as well as its directions, which are determined by the type of criminal offense resulting from domestic violence, as well as the functional conditions of a specific subject.
