Legal Status of RoadTraffic Participants: Modern Principles

Abstract

Abstract. The article focuses on the problems of road safety, which is one of the key indicators of the development of society. This need is due to the fact that in recent decades the world has seen a rapid increase in the number of vehicles and an increase in traffic intensity, which leads to an increase in the number of traffic accidents and their negative consequences. It has been established that a large number of vehicles are an integral part of the economy of countries, but at the same time, vehicles pose a danger to the lives of citizens. It has been determined that an urgent solution is needed to reduce the mortality rate due to road accidents, the severity of the consequences of road accidents for road users, and the reduction of socio-economic losses from road traffic injuries. If we mean road users, then the subject here is a car, and people are represented by traffic participants, between whom certain relationships are formed. Status thus provides an individual’s objective need for self-realization, provides him with social, legal, material and other opportunities, and various options for behavior in different spheres of life. It was determined that only at the stage of implementation of the status of citizens is its specific content expressed, the connection with legal reality is manifested. Thus, the assignment of legal status should be considered through the prism of the performance by road traffic participants of certain social functions in the field of production, management, everyday life, leisure, etc. Road traffic as an object of legal regulation provides one of the most important areas in which the interests of the state and the individual are reflected. This area includes practically all citizens who realize public interests or personal needs as subjects. Thus, the analysis showed that the prerequisite not only for the economic and social development of society, but also the guarantee of the safety of life and health of citizens is compliance by road traffic participants with the Rules of the Road, which are provided for by the current legislation of Ukraine. Based on the identified problems, it was formulated that the status imposes certain obligations on road traffic participants, the failure to fulfill which is the basis for holding them legally liable.
