Administrative and Legal Mechanism for the Implementation of Socio-Economic Rights of Persons with Disabilities in Ukraine: Issues of Pension Provision and Challenges of Public Policy

Abstract. The study provides an analysis of the administrative and legal framework for ensuring the socio-economic rights of persons with disabilities in Ukraine, taking into account current transformations in state social policy. Particular emphasis is placed on the role of pension provision as one of the key components of the mechanism for implementing social guarantees for this category of the population. The specific features of legal regulation governing the processes of formation and practical implementation of public policy in the field of social protection of persons with disabilities are identified. It is established that the current regulatory framework lacks sufficient coherence, contains certain inconsistencies, and fails to ensure a comprehensive approach to determining the content and scope of social guarantees. Certain directions of pension system reform are examined, the implementation of which may result in the narrowing of guarantees for persons with disabilities, particularly for representatives of the security and defense sector who have acquired such status in the course of performing their official duties. The risks associated with the application of generalized approaches to the regulation of special pensions without taking into account the specific legal status of such persons are emphasized. It is substantiated that the imperfection of administrative and legal instruments in this area may generate not only social but also broader societal and security-related consequences, including a decline in public trust in state institutions and a negative impact on motivation for service in the security and defense sector. The results of the study are summarized, and directions for improving public policy in this field are proposed, including the introduction of differentiated approaches to pension provision, enhancement of legal certainty, and harmonization of the regulatory framework.
