THE CONCEPT AND ESSENCE OF «EMERGENCY SITUATION» AS A LEGAL CATEGORY
Abstract
У статті досліджено сутність поняття «надзвичайна ситуація». Встановлено,
що шляхом урахування потреб суспільства і держави є можливість сформувати якіс-
ний понятійний апарат, який відповідатиме принципу правової визначеності, оскіль-
ки за допомогою такої визначеності юридичні норми стають чіткими і точними та
спрямовуються на забезпечення того, щоб ситуації та правовідносини залишались пе-
редбачуваними. Розглянуто широкий спектр дефініції понять «надзвичайна ситуація»,
що використовується в національному законодавстві, у вітчизняних і зарубіжних на-
укових джерелах. Використання різних наукових підходів (систематизації, порівняння
та аналізу) дозволило в досліджуваному понятті виокремити характерні його ознаки.
Зазначено роль і місце поняття «надзвичайна ситуація» у правотворчих і правозасто-
совних процесах у сфері цивільного захисту.
